According to U.S. Attorney Paul J. Fishman’s office Bernard Greenspan, 78, is facing a reckoning accusation recounting to payments and wire deception. Damien Conforti of Newark, the Greenspan’s attorney said that he has denied all the allegations and said they are falsely accused to him. There are about thirty nine individuals who had already beseeched guilty in the bribery case that involves the Bio-diagnostic Laboratory services. Scott J. Lampert, a special agent who is in charge at the Office of Inspector General, U.S. Department of Health and Human Services said that the incident reminded that the kickbacks which are connected to the federal health care programs are illegal and unacceptable and taking payments of such cases threatens the idea of treatment of patients before monetary profits.

According to the indictment the tests that are sent by Greenspan profited the lab with more than $3 million and in result the lab paid the doctor $2,000 to $2,500 a month as the rent payments, the service agreements and the consulting agreements all of which summed up to about $200,000. Also Greenspan called for additional patient tests in return for payment that he received for holiday parties for him and his stuffs. The doctor along with the lab had an agreement in which the lab consented to employ an unnamed person with whom Greenspan was supposedly having an affair.

An EMT and a former vice president have filed a complaint against the medical and Medicaid Programs due to certain irregularities. According to Conforti the prosecutors perverse what Greenspan regard as a good patient care and to fit their needs. He also said that he did not want to address unambiguous allegations as he is saddened by the charges against the doctor and considers that Greenspan has served his patients well in Bergen and Passaic counties for nearly five decades.

Almost a number of 40 people already have pleaded guilty in the scheme that involves a blood testing lab that bribed doctors for recommendations. Prosecutors said that the Bio-diagnostic Lab Services bribed Greenspan with magnified rent payments and consulting fees which totaled to $200,000 over a seven-year period. Greenspan’s attorney told jurors that the payments were legitimate and that his client did nothing illegal. The lab’s owner, David Nicoll, has pleaded guilty and is supposed to substantiate. According to the authorities he used the scam to buy luxury properties and rare and expensive automobiles.
